Council will not support rezoning application

For those who may not yet have heard the news, the independent consultant assessing the Colys rezoning and planning proposal, did not support either the rezoning or the planning proposal and recommended that Council did not refer the matter on to the NSW government’s “Gateway” process.

The following recommendation gained the unanimous support of those Councillors able to vote on the matter at a full Council meeting on Tuesday 16 November.

“Recommendation:

That in regard to the Planning Proposal (Rezoning) of Lot 204 DP771030, Marshall Street, Kangaroo Valley (Cardno Forbes Rigby Pty Ltd for the Colys Group), Council advise the proponent that:

 

The proposal is considered to be inconsistent with current policies, including Development Control Plan (DCP) No 66 (Kangaroo Valley), and is not supported;

Once exhibited, submissions could be made to the Draft Shoalhaven LEP 2009 and the draft Growth Management Strategy if required;

Any future submission and/or planning proposal for the site should give consideration to the report entitled “Assessment Report: Kangaroo Valley Rezoning Proposal” (October 2010), by Locale Consulting Pty Ltd; and

Council work with the Kangaroo Valley community, through the Growth Management Strategy process, to discuss opportunities for future small scale residential and aged care development in Kangaroo Valley”

 

In other words, any future proposal for this land will be assessed against the Consultant’s report; and Council will talk to our community about future “small scale residential” development.

 

What this result represents for the KV community is proof that “people power” can work.

All the submissions, letters, attendances at meetings – both in the Valley and at Council – have clearly demonstrated that the majority did not support this proposal. (Council received just six responses to the questionnaire which supported the plan.)

 

The No Zone Change group -  made up of representatives of KV Environment Group, KV Tourist Association and KV Community Association – shares this success with the community.

We thank the three groups for their generous financial support of this campaign.  

These three groups chased off the State government’s plans to raise Tallowa Dam, and the KV Community Association was instrumental in leading the opposition to a Feedlot in Glenmurray Road.
